NO Visa prior to the lease commencing?

If you were not successful in receiving a visa to study in Australia before the commencement of your lease start date, the property management asks that you complete the following actions: A written email requesting cancellation, which must be submitted to the property at which your booking is held within 24 hours of you receiving notification from the Department of Home Affairs, along with the email from the Department of Home Affairs advising your refusal notice to study in Australia. You will then be formally advised that your lease agreement will then be cancelled without penalty.

After the commencement of lease?

If you are cancelling after the commencement of your lease date due to not receiving a visa to study in Australia the property management asks that you complete the following actions: A written email notifying that you wish to terminate your lease, which must be submitted to the property at which your booking is held within 4 hours of you receiving notification from the Department of Home Affairs, along with the email from the Department of Home Affairs advising your refusal notice to study in Australia. The Property Manager will consider your request for the breaking of your lease and advise whether your request has been accepted.

When considering prematurely terminating your License to Occupy (Tenancy Agreement), it is your responsibility to do all of the following:

1. Continue to pay rent as per the agreement until the unit is re-let. They will refund any monies owed to you if and when the unit is re let

2. Find another suitable person to take over your unit so there is a continuation of payments to the unit owner

3. In all cases the unit must still be returned to the same standard that it was in at the commencement of the lease.

4. In case an Early Termination request is approved, the tenant must give 28 days’ notice and will still be liable to pay rent during that period

5. An Early Termination / Administration Fee of one weeks’ worth of rent will apply
