A Residential Tenancy Agreement may be terminated if:
1. You fail to pay rent by the due date and Notices to Remedy have not been satisfied.
2. You incur any breach of the Residential Tenancy Agreement
When considering prematurely terminating your Residential Tenancy Agreement, it is your responsibility to do the following:
1. Continue to pay the rental payments for the remainder of the agreement or until the apartment is re-let plus a portion of the letting fee, calculated according to the Residential Tenancies Tribunal formula.
2. You man help in finding another suitable person to take over your apartment so there is a continuation of payments to the apartment owner.
3. In all cases a departure cleaning fee applies.
NO Visa prior to the lease commencing?
If you were not successful in receiving a visa to study in Australia before the commencement of your lease start date, the property management asks that you complete the following actions: A written email requesting cancellation, which must be submitted to the property at which your booking is held within 24 hours of you receiving notification from the Department of Home Affairs, along with the email from the Department of Home Affairs advising your refusal notice to study in Australia. You will then be formally advised that your lease agreement will then be cancelled without penalty.
After the commencement of lease?
If you are cancelling after the commencement of your lease date due to not receiving a visa to study in Australia the property management asks that you complete the following actions: A written email notifying that you wish to terminate your lease, which must be submitted to the property at which your booking is held within 4 hours of you receiving notification from the Department of Home Affairs, along with the email from the Department of Home Affairs advising your refusal notice to study in Australia. The Property Manager will consider your request for the breaking of your lease and advise whether your request has been accepted.
Tenants are responsible to pay the rent until a replacement tenant has signed the lease agreement. The tenant will be charged a reletting fee which is up to maximum of 2 weeks rent plus GST, plus the departure clean and any remaining sundry charges.
